Federal and Texas State Drug Crimes defense overview

The United States government is cracking down hard on drug trafficking and other serious drug violations. If you have been arrested on a federal drug charge, you need a skilled and accomplished criminal defense attorney now. At Kuniansky & Associates in Houston, TX, Richard Kuniansky has over 30 years experience and is proficient in federal drug law.

Our drug trafficking defense practice handles high-profile federal drug cases, representing clients facing charges under the federal Controlled Substances Act including drug possession, possession with intent to distribute illegal drugs, and conspiracy to possess with intent to distribute controlled substances.

In the early 1980's, Richard Kuniansky served on the Presidential Drug Task Force in Miami, Florida, prosecuting the largest drug cases in the United States at that time. This experience allows him a unique insight into the prosecution's strategies, enabling him to formulate a strong, effective defense.

Mr. Kuniansky has successfully represented clients in a number of serious federal drug trafficking cases across the country, including the following:

  • In a jury trial in federal court in Corpus Christi, Texas, Mr. Kuniansky obtained a not-guilty verdict on behalf of a client who had been stopped at a checkpoint while entering the United States and charged with hauling a tractor-trailer filled with marijuana across the Texas-Mexico border.
  • In a federal drug case in Houston, Texas, Mr. Kuniansky was able to obtain the return of $135,000 (less one-third attorneys fees) that was seized at the time of arrest, and a dismissal of charges on behalf of a client facing a minimum mandatory 20 year prison sentence for possession with intent to distribute LSD.
  • In Beaumont, Texas, Mr. Kuniansky represented a client charged with conspiracy to possess with intent to distribute cocaine, facing a minimum mandatory 20 year prison sentence. He filed a motion to suppress the identity of the client, which was granted, followed by a government dismissal of the case.

If you have had a drug arrest and are subsequently found guilty of possessing or trafficking a controlled substance, the sentence can range from a fine and counseling to years of incarceration in prison. The factors determining the outcome depend upon the amount and kind of drug as well as the quality of your legal representation.

In Texas state court, felony drug cases are classified as first degree, second degree, third degree, and state jail felony. The first degree is the most serious and carries a maximum sentence of imprisonment for life.

Drug crimes are aggressively prosecuted in Texas. All too often individuals are convicted of a drug crime despite the fact that the state has little evidence to hold down the charge. In addition, the alleged offender’s constitutional rights may have been violated during the arrest, thereby nullifying the charges.
